This Privacy Policy describes the types of personal information we collect at Kayden Manufacturing, (the “Site“), how we may use that information and with whom we may share it. Our Privacy Policy also describes the measures we take to protect the security of this information as well as how you may reach us to update your contact information, remove your name from our mailing list, or ask us any questions you may have about our use of your personal information. This policy also explains how you may elect to stop receiving communications about our products and services.

You may choose to provide us with personal information when you visit our Site. For example, if you decide to complete an online survey, access our Buildertrend online portal, complete a user registration form, or make a purchase, you may be asked to provide certain information such as your contact information (name, email address, mailing address, and telephone number), age group and gender. If you decide to place an order, we will also need to know your billing address, credit card number, and expiration date. To protect your personal information, users registering at the Site must also enter a username/email address and password.

If you would prefer that we not collect any personal information from you, please do not provide us with any such information.

2. Use of Personal Information by Kayden Manufacturing: How We Collect Your Personal Information

a. Marketing Emails

If you so elect, the information you provide may be used by Kayden Manufacturing to create and deliver to you emails such as our newsletters, surveys, or other email messages containing product and event information (“Emails”). If you do elect to receive them and later decide that you would no longer like to receive these Emails, see the Deactivate or Change Your Status section below.

b. Text Messages

If you so elect, you may provide your mobile phone number to receive text message alerts containing product, event, and promotions information (“Text Messages”). There is no fee from Kayden Manufacturing to receive Text Messages, however, your mobile service provider may charge you for sending and/or receiving text messages, airtime, and any other standard applicable rates charged by your mobile service provider. If you do elect to receive them and later decide that you would no longer like to receive these Text Messages, see the Deactivate or Change Your Status section below.

c. Communications to Serve You

If you have elected to provide us with your contact information, we may provide you with service-related announcements by email or direct mail concerning the Site. We may also contact you regarding your customer service requests or questions or your order. For example, registered users may receive a welcoming email to confirm their registration. These types of communications are necessary to serve you, respond to your concerns, and provide the high level of customer service that Kayden Manufacturing offers its customers and that you come to expect.

d. Special Events, Questionnaires, and Surveys

On occasion, Kayden Manufacturing may sponsor special events (such as contests, sweepstakes, or other offerings), questionnaires, and surveys. There may be specific rules applicable to these promotions that explain how any personal information provided in the aforementioned special events, questionnaires, and surveys will be processed.

In addition, we do not sell or otherwise disclose personal information about our Site visitors except as described here.

The Service here is intended for persons not less than thirteen (13) years of age. If you are under 13, you are not permitted to use the Service and should not send any Personal Information to us. We may also not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.
• Restrictions: You have the right to restrict our processing of your Personal Data under certain circumstances. In particular, you can request we restrict our use of it if you contest its accuracy, if the processing of your Personal Data is determined to be unlawful, or if we no longer need your Personal Data for processing but we have retained it as permitted by law.
• Portability: To the extent the Personal Data you provide Latham Pool Products is processed based on your consent, you have the right to request that we provide you a copy of, or access to, all or part of such Personal Data in structured, commonly used and machine-readable format. You also have the right to request that we transmit this Personal Data to another controller, when technically feasible.
• Withdrawal of Consent: To the extent that our processing of your Personal Data is based on your consent, you may withdraw your consent at any time by closing your account. Withdrawing your consent will not, however, affect the lawfulness of the processing based on your consent before its withdrawal, and will not affect the lawfulness of our continued processing that is based on any other lawful basis for processing your Personal Data.
• Right to be Forgotten: You have the right to request that we delete all of your Personal Data. We will only delete your Personal Data when we no longer have a lawful basis for processing your Personal Data or after a final determination that your Personal Data was unlawfully processed. We may not accommodate a request to erase information if we believe the deletion would violate any law or legal requirement or cause the information to be incorrect. In all other cases, we will retain your Personal Data as outlined in this policy. In addition, we cannot completely delete your Personal Data as some data may rest in previous backups. These will be retained for the periods outlined in our disaster recovery policies.
• Complaints: You have the right to submit a complaint with the applicable supervisory authority in the country or the jurisdiction you live in, the country or jurisdiction you work in, or the country or the jurisdiction where you believe your rights under applicable data protection laws have been violated. We do not “Sell” (as defined in the CCPA) your personal information which we have collected or may collect and in the event we will sell your personal information, we will notify you by updating this Website Privacy Policy, and we will provide you with the option of opting out of such “sale”.
